GENERAL CONDITIONS:
1.1) The customer hereby agrees to purchase and Rigby (London LTD) (hereafter called “The Company”) agrees to sell the goods as specified. Where applicable the customer must agree to allow the company’s representatives access to the installation address during normal working hours to carry out the survey and completion of contract.
1.2) The contract is accepted on the basis that when any delivery/ installation is given it is offered in good faith conditional upon being able to acquire the necessary labour and materials and without responsibility for delays beyond the company’s control, caused by shortage of materials, strikes, accidents or any other unspecified delays outside the company’s control. Furthermore, if applicable no items can be ordered until survey documents have been signed and returned to the company.
1.3) Any defects attributed to the faulty materials 0r bad workmanship must be notified in writing to the company within seven days of completion, whereupon such defects will be inspected and if liability for the same is accepted they will be rectified at the company’s expense. Thereafter your installation will be covered under the terms of your guarantee.
1.4) This document includes the whole terms of the contract and no representation, warranty, statement or undertaking whether verbal or in writing shall be capable of being treated as forming part of the contract unless the same shall be agreed in writing and signed by a director of the company and the customer, and be attached to the contract document. Neither can the conditions stated on this contract be modified without the above applying. Any extras requested or found to be necessary at the time of survey and installation will be notified to the customer who will sign and accept that payment for these extras will be added to the outstanding balance of the contract.
1.5) The customer must accept delivery/ installation of this contract within 30 days of notification of manufacturing completion. Thereafter the contract goods will be invoiced for payment in full ( less installation charge). An installed contract is deemed completed with the iternised products stated in your quotation have been installed. Payment will be due at this time.
1.6) All goods are guaranteed for 12 months from the date of installation or supply.
1.7) The Policy of Rigby ( London) LTD is one of continuing improvement and the right to change expenditure at any time without notice is reserved.
FIREPLACES AND FIRES:
2.1) The contract price does not include redecoration, repairing floorboards or refitting skirting boards. The company will remove skirting boards prior to installation but cannot be held responsible for the damage caused to same during this process.
2.2) The Company can not be held responsible for natural faults or cracks due to excessive heat which may develop in marbles, stones, slates or granite after they have been supplied or fixed in position. Furthermore, the company is not responsible for firebricks, refactory bricks or hearths which crack under intense heat.
2.3) It is the customer’s responsibility to clean brass or stainless steal, which will tarnish.
2.4) In the development of a quarry or mine inevitable variations will occur in the materials colour, shade and veining, therefore the samples shown will not necessarily depict the colour supplied. However, we guarantee the materials to be of that particular quarry or trade name specified on the contract. Furthermore, all natural products cannot be guaranteed for uniformity of appearance, texture or of soundness, subsequently all materials sold and accepted to their natural defects which will be stopped and repaired as necessary before delivery or installation.
2.5) Natural stones will have flecks and blotches visible on their surface which must be accepted as unavoidable markings in natural stone. The polished surface of marble and granite will vary due to the porosity variations across the material . This affect is called ‘blooming’ which must be accepted by the customer.
2.6) Solid unslabbed marble, granite or slate can only be used for gas effect fire applications. Therefore, when a fireplace has been sold for these conditions it is the customers responsibility to ensure that it does not contravene Building Regulations for a Class 1 fireplace if it is subsequently used a real fire application.
2.7) It is the customer’s responsibility to have the chimney swept and inspected for efficient operation prior to the installation.
2.8) No guarantee can be given as to the level of noise emitted from fan assisted fires. This will depend upon the construction of the wall penetrated and type of fireplace installation.
WARRANTY INFORMATION:
At Rigby’s we offer a one year warranty on all complete fireplace installations. This covers call out, parts and
Labour that may be required.
Terms and conditions:
- We do not cover any products not supplied by Rigbys .
- We do not cover any natural stone products such as Granite, slate, marble etc..
- Rigby’s has the right to refuse warranty if the fireplace has been mis-used or tampered with
- In some cases Rigby’s may refer you to the manufacturers of the fireplace for warranty issues.
MANAFACTURER’S WARRANTY:
All of Rigby’s products will also come with the manufacturer’s warranty. Before we install your product you must
Read through the manufacturer’s warranty information. You can find this information on the manufacturer’s website.
To ensure the manufacturer’s warranty you must do the following:
- For any solid fuel fires/ stoves/ liners, The chimney must be swept annually.
- For any gas fires, the fires must be serviced annually.
- The product must be registered, you can do this via the manufactures website or filling out the information on the user manual and send via post.
- You must read the manufacturer’s warranty to check which parts are covered.
Please keep any paperwork relating to any warranty as it may be needed for proof of claim e.g. Service invoices, Commissioning Checklist, Gas Certificates.
RETURNS POLICY:
Our policy lasts 30 days. If 30 days have gone by since your purchase, unfortunately we can’t offer you a refund or exchange.
You must return the goods in the same condition that you received it. It must be unused and in its original packaging.
Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund.
If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within a certain amount of days.
